Will OF C. C. CHRISTMAS:

NORTH CAROLINA : WARREN COUNTY I, C. C. Christmas, being of sound mind and disposing memory do make and declare this to be my Last Will and Testament.

1. I want all my just debts paid by my Executor hereinafter named out of the first funds coming into his hands.

2. I give and devise to my beloved wife, Phoebe Christmas, in lieu of her dower, the dwelling house in which we now reside and Fifty (50) acres of the land on which it is situated during her natural life, and that at the death of my said wife, all the property hereby devised to her as aforesaid I give unto my four children born of her. Nehemiah Christmas, Phebe Christmas, Caleb Christmas, and Martha Christmas and to their heirs and assigns forever.

3. I give and devise to my daughter, Essie Christmas, two acres of land whereon the dwelling house near Green Wood Church is situated and is now occupied by Alfred Davis, Jr. and her heirs and assigns forever.

4. I give and devise the remainder of my real estate to my first wife's children except Mary Watson, for whom has otherwise been provided. Louisa Woodson, Sallie Lee, Nanni West, Seth Christmas, C. C. Christmas, Jr., and Elnora Bradford and their heirs and assigns forever.

5. I give and bequeath to my daughter, Mary Watson, Five ($5.00) Dollars.

6. I hereby appoint my son, Seth Christmas, my Executor, to execute this my Last Will and Testament with the request that he be not required to give any bond.

IN TESTIMONY WHEREOF, I have hereunto set my hand and affixed my seal this 14th day of August, 1914.

DEED: WILLIAM D. JONES to CHRISTOPHER C. CHRISTMAS

THIS INDENTURE, made and entered into this 27th day of
December A.D., One Thousand Eight Hundred and Sixty-seven,
between William D. Jones, of the County of Warren and State
of North Carolina, of the first part, and Christopher C.
Christmas, a freedman, formerly a slave of Lewis Y.
Christmas, deceased, of said County, of the second part,
Witnesseth:

WHEREAS, the said Lewis Y. Christmas, in his Will,
bequeathed a legacy of Ten Thousand Dollars to certain of
his slaves, in the said Will named, and in the proportions
therein stated, which legacy was charged on the residue of
his estate real and personal, which was devised and
bequeathed by his said Will to the said William D. Jones;
and

WHEREAS, a suit was lately brought in the Court of Equity of
Warren County aforesaid in the name of the said legatees
against Joseph S. Jones, Executor of Lewis Y. Christmas,
and others, for the recovery of the said legacy, which at
the last Term of said Court was transferred to the Supreme
Court, in which said suit the said Christopher C. Christmas
is one of the parties; and

WHEREAS, it has been agreed between the parties to this deed
that the said William D. Jones was to convey to the said
Christopher C. Christmas, in fee simple, a certain tract or
parcel of land hereinafter described in full satisfaction
and discharge of his share of the said legacy, and that the
said Christopher C. Christmas, in consideration thereof
should release all claim to any part of the said legacy to
the said Joseph S. Jones, Executor as aforesaid, and the
said William D. Jones; and

WHEREAS, the said Christopher C. Christmas has this day
executed a release according to the said agreement.

NOW THIS INDENTURE, WITNESSETH, that the said William D.
Jones in consideration of the premises, and the further
consideration of the sum of One Dollar to him paid by the
said Christopher C. Christmas, before the execution of this
deed, (the receipt whereof is hereby acknowledged) hath
bargained, sold and conveyed, and doth hereby bargain, sell
and convey unto the said Christopher C. Christmas and his
heirs and assigns forever the said tract of land situated in
Warren County aforesaid, on the road leading from Warrenton
to Louisburg, containing about ninety-four acres, and
bounded as follows:

BEGINNING at a small cedar on the South side of said road
and running South 24 East 120 Poles to a bunch of Gums on
the South side of the Long branch; thence, down said branch
to where the old road crosses; then leaving the branch by
said old road North 1 1/2 East 50 Poles, then North 10 West
20 Poles 20 Links to Ransom's old corner white oak (now
Watson's); thence, North 85 1/4 East 82 Poles 20 Links to a
stone; thence, North 69 Poles 5 Links to a Turkey oak bush
marked for a corner on the Louisburg Road; thence, along
said road Westwardly to the BEGINNING; and adjoining the
lands of the said William D. Jones and others, and

THE SAID WILLIAM D. JONES doth hereby bind himself, his
heirs, executors and administrators to warrant and defend
the title to the said tract of land unto the said
Christopher C. Christmas, his heirs and assigns forever.

IN TESTIMONY WHEREOF, the said William D. Jones hath
hereunto set his hand and affixed his seal the day and year
first above written.

[WHT: Reviewed the original Will of Erasmus Christmas at the NC Archives; appears to be son of Lewis. The following was taken from that will: Dated April 29, 1907 - Probated Aug. 21, 1911. Leaves whole estate to his wife, Cylestia, during her life time, then daughter Sarah Christmas to get the residence and 21 acres. Other daughters: Candis A. Revis, Caldonia Carter & Lillian Christmas. Sons: Elias Christmas to get 73 acres & Richard Christmas $1.00. Julius W. Harris was trustee. Wit: John Jenkins, Julius W. Harris & R. P. Green.]
